Brazil: betting facts (2026)

Betting in Brazil is licensed by the Secretaria de Prêmios e Apostas of the Ministry of Finance (SPA/MF).

Online betting is banned in Brazil since 25 September 2026. Provisional Measure (MP) 1.394/2026 prohibits the operation, offer, intermediation and advertising of fixed-odds betting (sports and online games) nationwide, including by foreign operators targeting people in Brazil. Authorisations granted under Law 14.790/2023 are extinguished 30 days after publication; operators had to take their sites offline 10 days after publication; new deposits are forbidden and open bets are void with stakes refunded. An MP has the force of law at once but lapses unless Congress converts it into law within 60 days, extendable once by 60 days.

Minimum age

Minimum age was 18 (Law 14.790/2023, art. 26, revoked by MP 1.394/2026 together with the betting regime).

Tax on winnings

Until MP 1.394/2026: net annual prizes from fixed-odds betting were taxed at 15% income tax (IRPF) under article 31 of Law 14.790/2023. MP 1.394 revoked that article together with the authorisations, so the rule concerns prizes won before the ban, not new betting.
